  Driving While Impaired (DWI) driving while impaired  

Driving a vehicle while under the influence of alcohol or other psychoactive substances. Also called impaired driving. You can be charged with DWI if you:

  • have a blood alcohol content (BAC) of more than .08%
  • fail or refuse to provide a blood or breath sample to the police
  • are believed by the arresting officer to be impaired by alcohol.
